29 CFR  1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  (a) On or about July 17, 2024, employees working on the ground to perform cleanup and assisting the roofers who were working directly above re-roofing the structure, were not protected from struck by hazards from falling materials and tools by wearing a protective helmet.

29 CFR  1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  (a)  On or about July 17, 2024, the employer did not ensure frequent and regular inspections of the job site were conducted by a competent person to ensure hazardous conditions were found and corrected.  Everardo Servin LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.20(b)(2) , which was contained in OSHA inspection number 1678064, citation number 1, item number 1 and was affirmed as a final order on December 12, 2023, with respect to a workplace located at 851 South Wilson Street, Hartford, WI 53027.

29 CFR  1926.501(b)(13):  Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  (a) On or about July 17, 2024, employees conducting roofing work on a new residential property roof with a 6:12 pitch, were not protected from falling to the lower level. This exposed employees to a fall hazard of approximately ten (10) feet off the roof to the ground below.  Everardo Servin LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1678064, citation number 2, item number 1 and was affirmed as a final order on December 12, 2023, with respect to a workplace located at 851 South Wilson Street, Hartford, WI 53027.  Everardo Servin LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1602630, citation number 1, item number 1 and was affirmed as a final order on August 2, 2022, with respect to a workplace located at N1655 Greenwood Road, Greenville, WI 54942.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards.  (a) On or about July 17, 2024, the employer did not ensure employees exposed to potential fall hazards had been properly trained to recognize and minimize the fall hazards associated with their work.  This is to include proper installation of anchor points, the proper selection of fall protection equipment and the proper use of the fall protection equipment.  Everardo Servin LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.503(a)(1), which was contained in OSHA inspection number 1678064, citation number 1, item number 2 and was affirmed as a final order on December 12, 2023, with respect to a workplace located at 851 South Wilson Street, Hartford, WI 53027.
