29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. a. Located at the job site at 7307 Coleman Place NW (Lot 107), Pickerington, Ohio 43147: An employee was observed utilizing a pneumatic nail gun to secure sheathing to the first story roof overhang of a new build residential building without utilizing eye protection. The employee was thereby exposed to struck-by hazards while performing this work.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. The employer does not protect each employee from the hazard of falling by the use of fall protection systems while performing framing work from heights. This most recently occurred on or about June 29, 2023, at the job site located at 7307 Coleman Place NW (Lot 107), Pickerington, Ohio. The employer failed to ensure that employees who were performing framing work on a new build residential structure were protected from fall hazards, thereby exposing them to an approximately eleven-foot fall hazard. Alfredo Sanchez was previously cited for Serious and Repeat-Serious violations of this Occupational Safety and Health Standard CFR 1926.501(b)(13), which was contained in OSHA inspection numbers: 1) 1651916, Citation number 2 - Item number 2, Issued 04/10/2023. 2) 1510955, Citation number 2 - Item number 2, Issued 03/31/2021. 3) 1496326, Citation number 1 - Item number 3, Issued 10/26/2020. Pursuant to 29 CFR 1903.19, the employer must submit documents describing steps it is taking to ensure compliance, including a description of how these steps protect its employees from the fall hazards.
