29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  (a) On or about October 18, 2023, the employer did not ensure that the competent person was conducting frequent and regular inspections of the job site to ensure fall protection was being worn, that fall protection systems were installed properly and job site conditions were maintained safe.

29 CFR  1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  (a) On or about October 18, 2023,  the employer did not ensure that the employee assisting in framing operations (ground worker) was protected from potential falling objects from above by the use of a protective helmet. This exposed the employee to a struck-by hazard from a height of  10 feet four (4) inches by material remnants and tools above the working employee.

29 CFR  1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  (a) On or about October 18, 2023, employee(s) conducting rough framing work while standing on the second floor of the structure, were not protected from falling to the lower level. This exposed employees to a fall hazard of approximately 17 feet at the rear of the structure and 10 feet 4 inches at the front.

29 CFR  1926.501(b)(14):Each employee working on, at, above, or near wall openings (including those with chutes attached) where the outside bottom edge of the wall opening is 6 feet or more above lower levels and the inside bottom edge of the wall opening.  (a) On or about October 18, 2023, employees were working in the first floor area of the structure while framing  interior walls near two exterior window holes located on the North and West sides of the structure. This exposed employees to a fall hazard of approximately 12 feet 4 inches onto dirt.

29 CFR 1926.1053(b)(4): Ladders were used for purposes other than the purpose for which they were designed:  (a) On or about October 18, 2023, employee(s) working on a framed residential structure did not insure an eight (8) foot self supporting portable step ladder used to access the second floor was used as designed. The eight (8) foot step ladder was left in the closed position and leaned against a framed wall, while the employee used the ladder to reach above, then step to the top plate and access the second floor.  This exposed employee to a fall hazard.

29 CFR  1926.1053(b)(13):The top or top step of a stepladder was used as a step:  (a) On or about October 18, 2023, employees were using a six foot step ladder to access the second floor of the structure during framing construction. This was done by climbing to the top step of the step ladder then stepping from the top of the ladder to the second floor joists. This exposed the employees to a fall hazard.
