29 CFR  1926.100(a):Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.  On or about October 17, 2023, at a work-site located at 6122 Archwood Rd, Independence Ohio 44131; during the installation of roofing material, the employer did not ensure employees working on the ground were protected from possible danger of head injury from impact, or from falling or flying objects, falling debris from working surfaces of heights approximately 8.8 feet.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  On or about October 17, 2023, during the installation of roofing material at a job site located at 6122 Archwood Rd, Independence Ohio 44131; the employer did not ensure employees working on a roof of a single family home were protected from a fall of approximately 8.8 feet by utilizing a fall protection system.  Construction by Monroy LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.501(b)(13) Duty to have fall protection), which was contained in OSHA inspection number 1482254, citation number 02, item number 01 and was affirmed as a final order on (8/6/2020), with respect to a workplace located at 7202 New Albany Links DR, New Albany Ohio 43054.  Construction by Monroy LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.501(b)(13) Duty to have fall protection), which was contained in OSHA inspection number 1442977, citation number 02, item number 01 and was affirmed as a final order on (3/1/2021), with respect to a workplace located at 6652 Ballantrae PL, Dublin Ohio 43016.  Construction by Monroy LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.501(b)(13) Duty to have fall protection), which was contained in OSHA inspection number 1421873, citation number 02, item number 01 and was affirmed as a final order on (9/25/2019), with respect to a workplace located at 1881 & 1883 Drew Ave, Columbus Ohio 43235.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  On or about October 17, 2023 at the job site located at 6122 Archwood RD, Independence Ohio 44131; during the installation of roofing material on a residential roof, the employer did not ensure portable ladders extend 3 feet above the upper landing surface.  Construction by Monroy LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.1053(b)(1) Ladders), which was contained in OSHA inspection number 1482254, citation number 01, item number 01 and was affirmed as a final order on (8/6/2020), with respect to a workplace located at 7202 New Albany Links DR, New Albany Ohio 43054.
