29 CFR 1926.102(a)(1):The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying objects while using a pneumatic nail gun: On or about June 10, 2025, at 19010 Chickasaw Road, Cleveland, OH 44119, the employer failed to ensure employees utilizing a pneumatic nail gun to secure weatherproofing to a residential were protected by eye/face protective devices in that employees were wearing no eye protection.

29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): On or about June 10, 2025, at 19010 Chickasaw Road, Cleveland, OH 44119, the employer failed to ensure employees installing weatherproofing on a residential home were protected from a fall of approximately 22 feet from a 6:12 pitch roof in that no personal fall arrest systems/devices were utilized. Construction by Monroy, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1705129, citation number 02, item number 001, and was affirmed as a final order on January 10, 2024, with respect to a workplace located at 6122 Archwood Road, Independence, OH 44131. Construction by Monroy, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1482254, citation number 02, item number 001 and was affirmed as a final order on August, 6, 2020, with respect to a workplace located at 7202 New Albany Links Drive New Albany, OH 43054.
