29 CFR  1926.100(a): Employees working in areas where there had been possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, had not been protected by protective helmets.  On or about October 27, 2023, R Garcia LLC did not ensure that employees working on the ground below roofing activities were protected by protective helmets from falling objects such as pneumatic nail guns, tools, shingles, and other materials or debris in a worksite at 201 Crystal Crossing Lane in Wentzville, Missouri.

29 CFR  1926.1053(b)(1): When portable ladders had been used for access to an upper landing surface, the ladder side rails had not extended at least 3 feet (.9 m) above the upper landing surface to which the ladder had been used to gain access.  On or about October 27, 2023, R Garcia LLC did not ensure that a portable ladder used to access the roof was extended at least 3 feet above the upper landing surface. The ladder extended approximately 1 foot above the upper landing surface in a worksite at 201 Crystal Crossing Lane in Wentzville, Missouri, which exposed employees to fall hazards.

29 CFR  1926.102(a)(1): The employer had not ensured that each affected employee had used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  On or about October 27, 2023, R Garcia LLC did not ensure that each employee exposed to eye hazards from flying particles while operating a pneumatic nail gun had used appropriate eye protection in a worksite at 201 Crystal Crossing Lane in Wentzville, Missouri.  R Garcia LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.102(a)(1), which was contained in OSHA inspection number 1669021, citation number 2, item number 1 and was affirmed as a final order on October 11, 2023, with respect to a workplace located at 32 Sonnet Court in Wentzville, Missouri.  R Garcia LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.102(a)(1), which was contained in OSHA inspection number 1633953, citation number 1, item number 2 and was affirmed as a final order on May 2, 2023, with respect to a workplace located at 652 Carlyle Avenue in Belleville, Illinois.

On or about October 27, 2023, R Garcia LLC did not ensure that each employee roofing a residential building at 201 Crystal Crossing Lane in Wentzville, Missouri, was protected by personal fall arrest systems. Employees were exposed to falls from 10 feet and greater.  R Garcia LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1669021, citation number 1, item number 1 and was affirmed as a final order on October 11, 2023, with respect to a workplace located at 32 Sonnet Court in Wentzville, Missouri.  R Garcia LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(10), which was contained in OSHA inspection number 1633953, citation number 1, item number 3A and was affirmed as a final order on May 2, 2023, with respect to a workplace located at 652 Carlyle Avenue in Belleville, Illinois.
