29 CFR  1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  HVAC and Carpenter Shops:  On and/or before November 2, 2023, employees conducted HVAC filter replacement, Drywall sanding, Dust Collector emptying where N95 respirators were required.  The employer had not provided medical evaluation to determine employee's ability to use a respirator which potentially exposed employees to wood dust and silica inhalation hazards.

29 CFR  1910.132(d)(2):  The employer did not verify, through a written certification, that the required workplace hazard assessment had been performed:  Carpenter Shop: On and/or before November 2, 2023, employees conducted HVAC filter replacement changes and emptied Wood Dust Collectors where personal protective equipment such as but not limited to gloves, safety glasses, and N95 respirators were required.  The employer had not conducted and documented a written hazard assessment for these processes which potentially exposed employees to dermal, eye, and wood dust inhalation hazards.
