29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system:   a) Jobsite located at 1300 12th St, Eddystone, PA: On or about December 6, 2023, the employer did not ensure employees on a walking/working surface with an unprotected side or edge which is 6 feet or more above a lower level were protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. Employees were performing framing work from the top of a 1.5-story residential building without the use of fall protection, thereby exposing employees to fall hazards of approximately 15 feet.  Level Edge Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(15) which was contained in OSHA inspection number 1567902, citation number 2, item number 2 and was affirmed as a final order on June 28, 2022, with respect to a workplace located at 411 Main Street Luzerne, PA 18709.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a) Jobsite located at 1300 12th St, Eddystone, PA: On or about December 6, 2023, the employer did not provide a training program for each employee conducting residential framing activities in the recognition and avoidance of fall hazards. Employees were framing the second story of a municipal building in close proximity to unprotected sides and edges without fall protection, thereby exposing employees to falls of approximately 15 feet.  Level Edge Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.503(b)(1) which was contained in OSHA inspection number 1567902, citation number 1, item number 5 and was affirmed as a final order on June 28, 2022, with respect to a workplace located at 411 Main Street Luzerne, PA 18709.  OR IN THE ALTERNATIVE   29 CFR  1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer:  a) Jobsite located at 1300 12th St, Eddystone, PA: On or about December 6, 2023, the employer did not provide a certification of training for each employee in the recognition and avoidance of fall hazards.   Level Edge Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.503(b)(1), which was contained in OSHA inspection number 1567902, citation number 1, item number 5 and was affirmed as a final order on September 2, 2022, with respect to a workplace located at 411 Main Street, Luzerne, PA.
