29 CFR 1910.147(c)(7)(i):The employer did not provide training to ensure that the purpose and function of the energy control program are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls are acquired by employees: On or about December 19th, 2023, an employee was engaged in commercial manufacturing activities, on the production floor of the facility located at 6161 Abbott Drive, Omaha, NE 68110, were exposed to amputation hazards in that the employer failed to provide training to employees assigned maintenance tasks for equipment that requires the isolation of hazardous energy sources. Instances of exposure include but are not limited to employees conducting maintenance at the point of operation on the YLM CNC Tube Bending Machine Number TB1 without applying the principles of Lockout/Tag-out.

29 CFR 1910.147(d)(4)(i):Lockout or tagout devices shall be affixed to each energy isolating device by authorized employees. On or about December 19th, 2023, an employee engaged in commercial manufacturing activities, on the production floor of the facility located at 6161 Abbott Drive, Omaha, NE 68110, were exposed to amputation hazards in that employees were conducting maintenance at the point of operation on the YLM CNC Tube Bending Machine Number TB1 without applying a lock and or tag as means of isolating hazardous energy sources and preventing unintentional restart of the equipment.

29 CFR 1910.212(a)(3)(ii): The point of operation of machines whose operation exposed an employee to injury, was not guarded: On or about December 19th, 2023, employees engaged in commercial manufacturing activities, on the production floor of the facility located at 6161 Abbott Drive, Omaha, NE 68110, were exposed to amputation hazards in that employees were using unguarded machinery. Instances include but are not limited to: a. Two employees are initiating the YLM CNC Tube Bending Machine Number TB1, each with an independent foot pedal located within 1 foot of the machine leaving both employees hands free, bending material that did not require two hands to hold during the operation.
