29 CFR 1926.1053(b)(1): When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet above the upper landing surface to which the ladder was used to gain access. (a) On January 29, 2024, at or near the jobsite located at 1040 Canada Avenue, Bismarck, ND employees were exposed to hazards associated with an extension ladder used by employees to ascend or descent from an elevated walking working surface, the ladder did not have rails that extended three feet above the upper landing surface or secured to the roof.
