29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system:  (a) On May 24, 2024, and at times prior, where the employer does not require the use of any form of fall protection during roofing work. This violation was most recently observed at 1104 Fifth Avenue NE in Mandan, North Dakota where employees were not protected from fall hazards greater than 11 feet while performing roofing activities. To abate this violation, the employer must ensure that its employee's performing roofing work are protected from falls, and that no employee is allowed onto a roof more than six feet high without adequate fall protection.  Note:  This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1690948, Citation 1, Item 1, and was affirmed as a final order on November 22, 2023, with respect to a workplace located at or near 1835 Calgary Avenue, Bismarck, North Dakota.  Note:  This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1626447, Citation 1, Item 1, and was affirmed as a final order on June 11, 2022, with respect to a workplace located at or near 421 Riverside Park Road, Bismarck, North Dakota.
