29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles:  a) On July 16, 2024, six employees were operating pneumatic nail gun to secure shingles to a roof at 2800 North Washington Street in Bismarck, North Dakota, were exposed to eye and face hazards from flying particles while working on a commercial roof without wearing impact resistant eye or face protection.

29 CFR 1926.502(d)(15): Anchorages used for attachment of personal fall arrest equipment were not capable of supporting at least 5,000 pounds per employee attached:  a) On July 16, 2024, at 2800 North Washington Street in Bismarck, North Dakota, employees were engaged in roofing activities on a commercial building were exposed to fall hazard greater than 6 feet while they were installing roofing materials on a commercial building. Employees had attached two ropes from their personal fall arrest system to the same anchor point on the northwest side. The anchor point was not designed for one person and not capable of supporting multiple attachments.   b) On July 16, 2024, at 2800 North Washington Street in Bismarck, North Dakota, employees were engaged in roofing activities on a commercial building were exposed to fall hazard greater than 6 feet while they were installing roofing materials on a commercial building. Employees had attached two ropes from their personal fall arrest system to the same anchor point on the north side. The anchor point was not designed for one person and not capable of supporting multiple attachments.

29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could neither free fall more than 6 feet (1.8 m), nor contact any lower level:  a) On July 16, 2024, at 2800 North Washington Street in Bismarck, North Dakota, employees engaged in roofing activities on a commercial building were exposed to free fall hazard greater than 6 feet while they were installing roofing materials on a commercial building well improperly using/attached to personal fall arrest system that would allow them to free fall distances greater than 6 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who was exposed to fall hazards that enabled each employee to recognize the hazards of falling and train each employee in the procedures to be followed in order to minimize these hazards:  a) On July 16, 2024, six employees were working at 2800 North Washington Street in Bismarck, North Dakota at heights of 6 feet or greater were engaged in roofing activities where fall protection systems were not installed or utilized in accordance with manufacturer's requirements.
