29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) 119 Spier Ave., Allenhurst, NJ: Employees were exposed to a fall hazard. Three employees were observed at a height of approximately 25 feet to the ground below. Employees were working on a 6/12 pitch HIP roof and were not wearing personal fall protection. Observed on or about 02/06/24. FDR Construction LLC; WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD, ITS EQUIVALENT, OR ESSENTIALLY SIMILAR STANDARD, 1926.501(b)(13) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER #1656820 CITATION NUMBER 1, ITEM NUMBER 5, ISSUED ON 09-07-2023. NOTE: FINAL ORDER DATE 10/05/2023. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) 119 Spier Ave, Allenhurst, NJ: Employees were exposed to a fall hazard of 25 feet to the ground below. Three employees accessed a HIP 6/12 pitch HIP roof from a ladder that did not extend the minimal three feet above the roof edge. Observed on or about 02/06/24. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
