29 CFR  1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system:  (a)Dalsin Inc., dba MJ Dalsin Roofing & Sheet Metal at 4510 West 41st Street, Sioux Falls, SD, 57106: On or about and at times prior to February 2, 2024, the  employer did not ensure employees were protected from falls while working on a flat roof conducting roofing operations. This condition exposed employees to a fall hazard greater than six feet.  Dalsin Inc., dba MJ Dalsin Roofing & Sheet Metal, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(10) which was contained in OSHA inspection number 1525716, citation number 2, item number 1 and was affirmed as a final order on May 24, 2021, with respect to a workplace located 421 West 8th Street, Sioux Falls, SD 57104.

29 CFR  1910.178(l)(6): The certification did not include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation:  a)Dalsin Inc dba MJ Dalsin Roofing & Sheet Metal at 4510 West 41st Street, Sioux Falls, SD 57106:  On or about and at times prior to February 2, 2024, the employer failed to ensure that powered industrial truck operators were certified as demonstrated by the successful completion of training and certification prior to operating. This condition exposed employees to struck-by hazards associated with operating a forklift without proper training / certification.  Abatement Note: Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace. All training should be documented, including employees name, date of last training and next refresher training date.

29 CFR  1910.178(a)(5):The powered industrial truck was equipped with front-end attachments other than factory installed attachments, however the employer did not request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered:  (a)Dalsin Inc., dba MJ Dalsin Roofing & Sheet Metal at 4510 West 41st Street, Sioux Falls, SD 57106: On or about and at times prior to February 2, 2024, the employer did not ensure that a powered industrial truck that was equipped with a front-end attachment other than a factory installed attachment was marked to identify the attachment and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered.  This condition exposed employees to struck by hazards associated with operating a forklift that is improperly balanced.

This condition exposed the employee to fall hazards greater than six feet.
