29 CFR 1910.134(f)(2):Employee(s) using a tight-fitting facepiece respirator were not annually fit tested: a.) Stronghold Digital Mining dba Scrubgrass Reclamation Company, LP, on or about February 29th, 2024 and times prior thereto: Employees were required to wear half mask air-purifying elastomeric respirators (3M brand #6300 with P100 cartridges) during work operations including, but not limited to work operations where visible dust was present throughout the powerplant. The employer did not ensure all employees were provided with annual fit tests. ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

29 CFR 1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function: a.) Stronghold Digital Mining dba Scrubgrass Reclamation Company, LP, on or about February 29th, 2024, and times prior thereto: Employees were required to wear half mask air-purifying elastomeric respirators (3M brand #6300 with P100 cartridges) during work operations including, but not limited to work operations where visible dust was present throughout the powerplant. Some employees who were required to wear elastomeric tight-fitting half mask respirators were not clean shaven. ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

29 CFR 1910.151(c):Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use: a.) Stronghold Digital Mining dba Scrubgrass Reclamation Company, LP, 1st floor battery room area, on or about February 29th, 2024, and times prior thereto: Employees worked with and around corrosive chemicals including, but not limited to, sulfuric acid during forklift battery charging operations. The emergency eyewash/shower station (plumbed) was not in compliance with ANSI/ISEA 358.1 for Emergency Eyewash and Shower Equipment in that: 1) The eyewash unit was not functioning properly, in that, upon activation the eyewash nozzle on the right side did not activate nor provide any flushing fluid. 2) The eyewash nozzles were not covered or protected from accumulations of dust/debris. 3) The plumbed eyewash/shower station was not being inspected and activated on a weekly basis. ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.
