29 CFR  1926.1053(b)(1):Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  On or about February 29, 2024, the employer Salgau Roofing, Inc. at jobsite located at 2128 Rivard Rd. Toledo OH 43615, did not ensure the side rails of one aluminum extension ladder was extended at least three feet above the landing surface. Eight subcontracted employees were exposed to falls from approximately 9 feet and 5 inches or greater from the top of the second (roof) level to the ground below while using a Gorilla Ladders brand multi-position ladder to access the second (roof) level to perform residential roofing activities on a single family home.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  On or about February 29, 2024, the employer Salgau Roofing, Inc. at jobsite located at 2128 Rivard Rd. Toledo OH 43615, did not ensure subcontracted employees were protected from falls while performing residential construction roofing activities atop a 6:12 pitch steep sloped second level roof deck. Eight subcontracted employees were exposed to falls of 15 feet and 5 inches from the peak and falls of 9 feet and 5 inches from the eaves to the ground below.  Salgau Roofing, Inc. was previously cited for a violation of an equivalent Occupational Safety and Health Standard 1926.502(f)(1)(i), which was contained in OSHA inspection number 1567657, citation number one, item number one-A and was affirmed as a final order on April 19, 2022 with respect to a workplace located at NW corner of N. Summit and Locust Streets in Toledo, Ohio.  Salgau Roofing, Inc. was previously cited for a violation of an equivalent Occupational Safety and Health Standard 1926.502(h)(1)(v), which was contained in OSHA inspection number 1567657, citation number one, item number one-B and was affirmed as a final order on April 19, 2022 with respect to a workplace located at NW corner of N. Summit and Locust Streets in Toledo, Ohio.  Salgau Roofing, Inc. was previously cited for a violation of an equivalent Occupational Safety and Health Standard 1926.502(b)(1), which was contained in OSHA inspection number 1545144, citation number one, item number one and was affirmed as a final order on December 1, 2021 with respect to a workplace located at 2829 Westchester Rd Ottawa Hills, Ohio.  Salgau Roofing, Inc. was previously cited for a violation of an equivalent Occupational Safety and Health standard 1926.501(b)(13) which was contained in OSHA inspection number 1367041 citation number 1, item number 1 and was affirmed as a final order on March 13, 2019 with respect to a workplace located at 632 Manitou Dr. Maumee, Ohio.
