29 CFR 1926.20(b)(1): The employer did not initiate and maintain programs necessary to ensure compliance with the Occupational Safety and Health Standards:   At the jobsite located at 2937 South Maize Court Wichita, KS 67215, employees engaged in residential roofing activities were exposed to struck-by, fall hazards, in that the employer failed to maintain a safety and health program to address hazards such as but not limited to fall protection during roofing activities. A safety and health program with policy, hazard assessment, and work site rules was not developed and/or implemented at this job site.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  At the jobsite located at 2937 South Maize Court, Wichita, KS 67215, employees engaged in residential roofing activities with the use of a pneumatic nail gun were exposed to struck-by hazards, in that employees were not utilizing eye protection.  Martin Urzua was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1509852, citation number 1, item number 1 and was affirmed as a final order on 03-23-2021, with respect to a workplace located at 8016 & 8018 34th Street, Wichita, KS.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  Employees engaged in residential roofing activities at the jobsite located at 2937 South Maize Court Wichita Kansas, were exposed to fall hazards of approximately 10.5 feet from the roof to the ground below in that fall protection was not utilized.  Martin Urzua was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1509852, citation number 1, item number 2 and was affirmed as a final order on 03-23-2021, with respect to a workplace located at 8016 & 8018 34th Street, Wichita, KS.  Martin Urzua was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1510007, citation number 1, item number 1 and was affirmed as a final order on 03-23-2021, with respect to a workplace located at 8034 & 8036 E. 34th Ct. S., WICHITA, KS 67204.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  Employees engaged in residential roofing activities at the jobsite located 2937 South Maize Court Wichita, KS 67215, were exposed to falls from approximately 10.5 feet from the roof to the ground below, in that the KPRO Keller aluminum ladder used to access the roof did not extend 3 feet from the eave of the roof.  The Martin Urzua was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1509852, citation number 1, item number 3 and was affirmed as a final order on 03-23-2021, with respect to a workplace located at 8016 & 8018 34th Street, Wichita, KS.
