29 CFR 1910.1200(g)(8): The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical: (Construction Reference: 1926.59) At the job site located at 2937 South Maize Ct. Wichita, Kansas 67215, employees engaged in roofing activities were exposed to chemical hazards in that they were not provided access to the Safety Data Sheets (SDSs) for Atlas ProLam asphalt/fiberglass shingles, Geocel 2300 Construction tripolymer sealant, and gasoline. The chemical hazards associated with these chemicals include: skin and eye irritation, drowsiness and/or dizziness, nausea and/or vomiting, respiratory tract irritation, is suspected of causing cancer and may be fatal if swallowed and enters airways. Additionally, Geocel 2300 Construction tripolymer sealant and gasoline, can both act as a fueling agents due to their extreme flammability as a liquid and vapor.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59) At the job site located at 2937 South Maize Ct. Wichita, Kansas 67215, employees engaged in roofing activities were exposed to chemical hazards in that a written hazard communication program had not been developed, implemented and maintained at the job site. Employees were handling Atlas ProLam asphalt/fiberglass shingles, Geocel 2300 Construction tripolymer sealant, and gasoline. The chemical hazards associated with these chemicals include: skin and eye irritation, drowsiness and/or dizziness, nausea and/or vomiting, respiratory tract irritation, is suspected of causing cancer and may be fatal if swallowed and enters airways. Martin Urzua was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.1200(e)(1), which was contained in OSHA inspection number 1510024, citation number 1, item number 1 and was affirmed as a final order on 03-23-2021, with respect to a workplace located at 8034-8036 E. 34th St. Wichita, KS 67204.
