29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) On or about 4/4/2024, at 3981 Bonstead Rd., Clay NY 13041: An employee was standing on and using the 2 inch x 4 inch girts of a new pole barn to install soffits, without fall protection of any kind, and exposed to a fall of approximately 7.4 feet. Martin Builders Enterprise, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1665405, citation number 1, item number 1(a) and was affirmed as a final order on 10/11/2023, with respect to a workplace located at 4975 Main St., North Rose NY.
