OSH ACT of 1970 Section (5)(a)(1):    The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crush-by hazards when utilizing damaged steel storage racks:  a) At Magic Tilt Trailers, Inc., located at 2161 Lions Club Road, Clearwater, FL, at or near the PARTS WAREHOUSE:  On or about April 17, 2024, the employer exposed employees to struck-by and crush hazards in that the employer continued use of storage bays of a metal racking system that were not properly marked with the maximum capacity storage ratings and where the framing was not anchored to the floor.    b) At Magic Tilt Trailers, Inc., located at 2161 Lions Club Road, Clearwater, FL, at or near the WAREHOUSE NEAR ALUMINUM WELDING:  On or about April 17, 2024, the employer exposed employees to struck-by and crush hazards in that the employer continued use of storage bays of a metal racking system that were damaged and not properly marked with the maximum capacity storage ratings.    c) At Magic Tilt Trailers, Inc., located at 2161 Lions Club Road, Clearwater, FL, at or near the  A2 LINE AND SMALL/LARGE LINE:  On or about April 17, 2024, the employer exposed employees to struck-by and crush hazards in that the employer continued use of a metal storage shelf that was not properly marked with the maximum capacity storage ratings and where the framing was not anchored to the floor.  Magic Tilt Trailers, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard OSH ACT of 1970 Section (5)(a)(1), which was contained in OSHA inspection number 1713854, citation number 1, item number 1 and was affirmed as a final order on March 25, 2024, with respect to a workplace located at 202 Relocation Road, Edgewater, FL 32141.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  a) At Magic Tilt Trailers, Inc., located at 2161 Lions Club Road, Clearwater, FL, at or near CUTTING &DRILLING (C&D) and the BUNKS SHOP - SAW 1:  On or about April 17, 2024, the employer exposed employees to  amputation and laceration hazards, in that a horizontal bandsaw which the employees use to cut aluminum tubing did not have guarding on the blade between the blade guide supports and the blade wheel covers.   b) At Magic Tilt Trailers, Inc., located at 2161 Lions Club Road, Clearwater, FL, at or near  CUTTING &DRILLING (C&D) and the  BUNKS SHOP - SAW 2:  On or about April 17, 2024, the employer exposed employees to  amputation and laceration hazards, in that a horizontal bandsaw which the employees use to cut aluminum tubing did not have guarding on the blade between the blade guide supports and the blade wheel covers.   c) At Magic Tilt Trailers, Inc., located at 2161 Lions Club Road, Clearwater, FL, at or near CUTTING &DRILLING (C&D)  and the  BUNKS SHOP - SAW 3:  On or about April 17, 2024, the employer exposed employees to  amputation and laceration hazards, in that a horizontal bandsaw which the employees use to cut aluminum tubing did not have guarding on the blade between the blade guide supports and the blade wheel covers.   d) At Magic Tilt Trailers, Inc., located at 2161 Lions Club Road, Clearwater, FL, at or near the  WINCH and MACHINE SHOPS - SAW 4:  On or about April 17, 2024, the employer exposed employees to  amputation and laceration hazards, in that a horizontal bandsaw which the employees use to cut aluminum tubing did not have guarding on the blade between the blade guide supports and the blade wheel covers.   e) At Magic Tilt Trailers, Inc., located at 2161 Lions Club Road, Clearwater, FL, at or near STEEL WELD SHOP- SAW 5:  On or about April 17, 2024, the employer exposed employees to amputation and laceration hazards, in that a horizontal bandsaw which the employees use to cut aluminum tubing did not have the blade guard attached inside the blade wheel cover.  f) At Magic Tilt Trailers, Inc., located at 2161 Lions Club Road, Clearwater, FL, at or near FABRICATION and ALUMINUM WELD - IRONWORKER 1:  On or about April 17, 2024, the employer exposed employees to amputation and laceration hazards, in that an ironworker used for shearing, bending, and notching did not have guarding at the 3 points of operation.   g) At Magic Tilt Trailers, Inc., located at 2161 Lions Club Road, Clearwater, FL, at or near BUNKS, WINCH and MACHINE SHOPS - IRONWORKER 2:  On or about April 17, 2024, the employer exposed employees to amputation and laceration hazards, in that an ironworker used for punching, shearing, and notching did not have guarding at the punching and shearing points of operation.   Magic Tilt Trailers, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.212(a)(1), which was contained in OSHA inspection number 1713854, citation number 1, item number 2 and was affirmed as a final order on March 25, 2024, with respect to a workplace located at 202 Relocation Road, Edgewater, FL 32141.
