29 CFR 1910.28(b)(15): Except as provided elsewhere in this section or by other subparts of 29 CFR part 1910, the employer must ensure each employee on a walking-working surface 4 feet (1.2 m) or more above a lower level is protected from falling by guardrail systems; safety net systems; or personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems: On or about May 16, 2024 at a facility located at 206 Charles Street in Oconto, WI; the employer did not provide fall protection when employees were on walking-working surfaces and exposed to falls of 4 feet or move to the lower level when; a) A Gel Coating employee spray applying gel coat to the interior of a boat mold was standing near and kneeling at the edge of the boat's mold which exposed the employee to a fall of approximately 6.3 feet to the ground. b) A Finishing employee sanding and working on top of a boat was kneeling and sitting near the edge of the boat's gunwale which exposed the employee to a fall of approximately 5 feet to the ground. c) An employee placing garbage in a dumpster from a truck-bay opening stood and walked on the top of the dumpster's wall to through and move garbage in the dumpster which exposed the employee to a fall of approximately 5 feet into the dumpster and approximately 6.6 feet to the ground below outside of the dumpster.

29 CFR 1910.94(c)(2): Spray booths or spray rooms are to be used to enclose or confine all operations. Spray-finishing operations shall be located as provided in sections 201 through 206 of the Standard for Spray Finishing Using Flammable and Combustible Materials, NFPA No. 33-1969: On or about April 29, 2024, at a facility located at 206 Charles Street in Oconto, WI; the employer did not enclose or confine all spray-finishing operations with a spray booth or spray room. An employee spray applied Gel Coat (Maxguard BG-NCP-20059 Black; flammable, toxic, irritant) to the interior of a boat hull in an unenclosed section of the facility adjacent to areas where employees performed lamination work.

29 CFR 1910.106(e)(2)(ii)(b)(2): The quantity of liquid that may be located outside of an inside storage room or storage cabinet in a building or in any one fire area of a building shall not exceed 120 gallons of Category 2, 3, or 4 flammable liquids in containers: On or about April 29, 2024, at a facility located at 206 Charles Street in Oconto, WI; the employer stored over 120 gallons of Category 2 and 3 flammable liquid containers outside of an inside storage room or storage cabinets. Approximately 1705 gallons of flammable liquids, comprised of at least 18 55-gallon drums of Category 3 flammable gel coat containers and 13 55-gallon drums of Category 2 flammable acetone containers, were stored in the open storage area along the southern central portion of the facility.

29 CFR 1910.106(e)(6)(ii): Grounding. Category 1 or 2 flammable liquids, or Category 3 flammable liquids with a flashpoint below 100 °F (37.8 °C), shall not be dispensed into containers unless the nozzle and container are electrically interconnected. Where the metallic floorplate on which the container stands while filling is electrically connected to the fill stem or where the fill stem is bonded to the container during filling operations by means of a bond wire, the provisions of this section shall be deemed to have been complied with: On or about April 29, 2024, at a facility located at 206 Charles Street in Oconto, WI; the employer allowed employees to dispense Acetone (Category 2 flammable liquid) from the nozzle placed into the 55-gallon drum of Acetone without electrically interconnecting or bonding/grounding the nozzle and secondary container exposing employees to potential fire hazards ignited by static electrical discharge.
