29 CFR  1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5).  On or about May 7, 2024, the employer failed to train and certify employees on how to safely operate a forklift prior to allowing them to operate. Employees with no forklift training operated the forklift to load or unload materials or product, exposing other employees to struck-by hazards.   Corrected during inspection.

29 CFR  1910.138(a): General requirements. Employers shall select and require employees to use appropriate hand protection when employees' hands are exposed to hazards such as those from skin absorption of harmful substances; severe cuts or lacerations; severe abrasions; punctures; chemical burns; thermal burns; and harmful temperature extremes.  On or about May 7, 2024, employees were exposed to burn hazards while changing propane from forklifts. The employer did not provide all of their employees with hand protection to protect against thermal burns.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1910.1200(e)(1):Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following:  On or about May 16, 2024, employees were required to change propane on forklifts. The employer did not develop, implement and maintain a written hazard communication program for employees working in proximity to propane, exposing them to health hazards such as frostbite.   Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).
