29 CFR 1926.300(b)(2):Moving part(s) of equipment exposed to contact by employees or which otherwise created a hazard, were not guarded: a) Lots #118 - 122: On or about May 21, 2024 and at times prior, the employer exposed employees to amputation and caught-in hazards, in that the belt and pulley of the LIFAN 4.0 HP Electronic Ignition motor for the Ladder Platform Shingle Hoist, TranzSporter, Model: TP250, Serial Num. 24937, did not have a guard, while employees were operating the hoist and walking/working around it.

29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed: a) Lots #118 - 122: On or about May 21, 2024, and at times prior, the employer exposed employees to fall hazards, in that the employer did not ensure a 40-foot ladder shingle hoist with a broken rung was not used to access the roof when employees were installing roofing shingles.

29 CFR 1926.501(b)(11): "Steep roofs." Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems with toe boards, safety net systems, or personal fall arrest systems. a) Lots #118 - 122: On or about May 21, 2024, and at times prior, the employer exposed employees to fall hazards, in that the employer did not ensure employees were properly tied off while installing shingles on a 6/12 pitch roof approximately 38 feet from ground level. The employer, Benito Popoca Casarreal, was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(11), which was contained in OSHA inspection number 1732956, citation number 1, item number 1 and was affirmed as a final order on April 23, 2024, with respect to a workplace located at Lot #11, 600 Cooper Road, Loganville, GA 30052.
