29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:  a) New residential construction located at Lot 35 Stewart Road, Cumming, GA 30041, Roof: On or about 06/20/2025, the employer exposed employees to fall hazards of approximately 12-feet, 4-inches to the lower level, in that a fall protection system was not provided to employees engaged in roofing activities.  Benito Popoca Casarrael was previously cited for a violation of this occupation safety and health standard or its equivalent standard 29 CFR 1926.501(b)(11), which was contained in OSHA Inspection Number 1749531, citation number 2, item number 1 and was affirmed as a final order date on 12/04/2024, with respect to a workplace located at Lots #118 - 122 Red Maple Crossing SE Smyrna GA 30080.

29 CFR 1926.502(d)(17): The attachment point of the body harness was not located in the center of the wearer's back near shoulder level, or above the wearer's head.  a) New residential construction located at Lot 35 Stewart Road, Cumming, GA 30041, Roof: On or about 06/20/2025, the employer exposed employees to 12-foot fall hazards while performing roofing operations, in that the employer allowed for the use of rock-climbing type harnesses and not full body harnesses as the connection to the harness was located near the waist and not middle of the wearer's back.  Benito Popoca Casarrael was previously cited for a violation of this occupation safety and health standard or its equivalent standard 29 CFR 1926.502(d)(17), which was contained in OSHA Inspection Number 1710085, citation number 1, item number 2 and was affirmed as a final order date on 12/18/2023, with respect to a workplace located at  Lot 469 Del Webb at Chateau Elan subdivision, Hoschton, GA.

29 CFR  1926.552(a)(4): Hoisting ropes were not installed in accordance with the wire rope manufacturers' recommendations.   a) New residential construction located at Lot 35 Stewart Road, Cumming, GA 30041: On or about 06/20/2025, the employer exposed employees to potential struck-by hazards, in that the employer did not follow the manufacturer's specifications of the TranzSporter Platform Hoist as the wire cable it was manufactured with was replaced using a rope.
