29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a- 4 Tori Lane, Manalapan NJ: The company worksite Foreman and their worker were exposed to fall hazards, in excess of 10 feet7 inches to ground surface, when accessing to and egressing from a residential structure's pitched roofs while using a portable, unsecured, aluminum extension ladder whose side rails extended approximately 15 inches above the surface being accessed to and egressed from. Condition noted on or about 05/29/24. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a- 4 Tori Lane, Manalapan NJ: A worker and the company co-owner were exposed to fall hazards, in excess of 10 feet 7 inches to the ground's surface below, when walking and working from a residential structure's pitched roofs without the use of fall protection. Condition observed on or about 05/29/24.
