29 CFR 1926.416(e)(1): Worn or frayed electric cords or cables were used:  a- 16 Jacob Francis Way, Ewing NJ: On or about  03/25/25 company workers and the worksite Foreman were exposed to electrocution hazards when operating a portable electric circular saw, powered with a damaged flexible cord, that was plugged into a damaged flexible extension cord.

29 CFR  1926.502(d)(16): Personal fall arrest systems, when stopping a fall, shall be rigged such that an employee can neither free fall more than 6 feet (1.8 m), nor contact any lower level:   a -16 Jacob Francis Way, Ewing NJ :   The company worksite Foreman was exposed to fall hazards, in excess of 23 feet 3 inches to the ground surface below, while working and walking from a residential structure's upper, pitched, partially sheathed roof while wearing a full body harness whose connected, lanyard's length would not have stopped them from contacting lower levels.   Condition observed on or about 03/25/25.  b - 16 Jacob Francis Way, Ewing NJ:   The company worksite Foreman was exposed to fall hazards, in excess of 23 feet 3 inches to the ground surface below, while working and walking from a residential structure's upper, pitched, partially sheathed roof while wearing a full body harness whose connected lanyard was wrapped around a upper roof truss chord and connected back to itself.  As such the lanyard was improperly anchored to an unrated anchor point and would not have stopped them from contacting lower levels.  Condition observed on or about 03/25/25.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii):   a - 16 Jacob Francis Way, Ewing NJ:   The company worksite Foreman was exposed to fall hazards, in excess of 23 feet 3 inches to the ground surface below, while working and walking from a residential structure's upper, pitched, partially sheathed roof while wearing a full body harnesss whose connected, lanyard's length, along with the unrated anchor point their lanyard was improperly connected to, would not have stopped them from contacting lower levels.  The worksite Foreman and their worksite workers had not received fall protection training as specified in 29 CFR 1926.503 (a)(2)(i) through (viii).   Condition noted on or about 03/25/25.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.1060(a)(1): The employer did not ensure that each employee was trained by a competent person which would enable each employee to recognize hazards related to ladders and stairs, and the procedures to follow to minimize those hazards.  a- 16 Jacob Francis Way, Ewing NJ:  A worker and the company worksite Foreman were exposed to fall hazards, in excess of 7 feet 4 inches and 14 feet, when seperately using two damaged portable aluminum extension ladders during sheathing installation and other related activities at the worksite. This worker and company worksite Foreman had not received ladder safety training from the company.  Condition noted on or about 03/25/25  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired:    a- 16 Jacob Francis Way, Ewing NJ:  A worker was exposed to fall hazards, in excess of 7 feet 4 inches to the ground surface, when applying sheets of OSB to exterior surfaces of a residential structure from a damaged aluminum extension ladder. Condition observed on or about 03/25/25.  a- 16 Jacob Francis Way, Ewing NJ:  The company worksite Foreman was exposed to fall hazards, in excess of 14 feet, when applying sheets of OSB to the exterior surfaces of a residential structure from a damaged aluminum extension ladder. Condition observed on or about 03/25/25.  New Contractor Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR 1926.1053(b)(16)), which was contained in OSHA inspection number 1737306, citation number 1, item number 2 and was affirmed as a final order on 05/2024, with respect to a workplace located at Building #2 - Rising Meadows Drive, Bordentown NJ.
