Note: The requirements applicable to construction work under this paragraph are identical to those set forth at §1910.178(l) of this chapter. 29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5). (a): On or about May 31, 2024, the employer did not certify that forklift operator(s) had been trained and evaluated as required by paragraph (l) with certification records. An employee was operating a Pettibone 6044 Telehandler Forklift to deliver roof trusses to the top of a new construction home, approximately 20.9 feet above the lower level. Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

Synthetic web slings shall be immediately removed from service if any of the following conditions are present: 1926.251(e)(8)(iii): Snags, punctures, tears or cuts. (a): On or about May 31, 2024, the employer did not ensure that damaged slings were removed from service. Damaged synthetic slings with cuts and tears were used to hoist and lower roof trusses, exposing employees to struck by hazards while using them. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. The employer does not protect each employee required to work from elevations during residential construction activities 6 feet or more above lower levels by providing and ensuring the use guardrail systems, safety net system, or personal fall arrest system, or providing alternative fall protection measures under provisions of paragraph 1926.501(b): (a): This most recently occurred on or about May 31, 2024 at 207 Davidson Drive, Elburn, Illinois. Employees are exposed to falls of approximately 20.5 feet or more above ground level while engaged in residential construction activities. Fall protection was not being utilized while installing trusses on the ceiling joists above the second level. 595 Construction LLC was previously cited for a violation of this occupational safety and health standard, 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1595058, citation number 1, item number 1, and was affirmed as a final order on 11-01-2022, with respect to a workplace located at 15917 W Orchid Lane, Lockport, IL 60441. 595 Construction LLC was previously cited for a violation of this occupational safety and health standard, 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1684870, citation number 2, item number 1, and was affirmed as a final order on 10-19-2023, with respect to a workplace located at Lot 5016 S. 29 CFR 1926.503(b)(1): The employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training. (a): On or about May 31, 2024, employees were exposed to fall hazards while performing roofing work and the employer did not certify that employees had been trained to recognize fall hazards, and the procedure to be followed in order to minimize those hazards. 595 Construction LLC was previously cited for a violation of this occupational safety and health standard, 29 CFR 1926.503(b)(1), which was contained in OSHA inspection number 1595058, citation number 2, item number 1, and was affirmed as a final order on 11-01-2022, with respect to a workplace located at 15917 W Orchid Lane, Lockport, IL 60441.
