29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59) At the job site located at 9001-9003 East Chris St. Bel Aire, KS 67226, employees engaged in roofing activities were exposed to chemical hazards in that a written hazard communication program had not been developed, implemented and maintained at the job site. Employees were handling TAMKO Heritage architectural asphalt shingles, Chem Link DuraLink 35 multi-purpose sealant, and gasoline. The chemical hazards associated with these chemicals include but not limited to; skin and eye damage/irritation, may cause an allergic skin reaction, drowsiness and/or dizziness, respiratory tract irritation, may cause cancer and may be fatal if swallowed and enters airways.

29 CFR 1910.1200(g)(8): The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical: (Construction Reference: 1926.59) At the job site located at 9001-9003 East Chris St. Bel Aire, KS 67226, employees engaged in roofing activities were exposed to chemical hazards in that they were not provided access to the Safety Data Sheets (SDSs) for TAMKO Heritage architectural asphalt shingles, Chem Link DuraLink 35 multi-purpose sealant, and gasoline at the job site. The chemical hazards associated with these chemicals include but not limited to; skin and eye damage/irritation, may cause an allergic skin reaction, drowsiness and/or dizziness, respiratory tract irritation, may cause cancer and may be fatal if swallowed and enters airways.
