29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  (a) On or about June 11, 2024, the employer did not ensure that the competent person was conducting frequent and regular inspections of the job site to ensure fall protection was being worn, that fall protection systems were installed properly, that ladders were installed properly, Personal Protective Equipment was being worn, that the Equipter RB4000 dump trailer was used as intended, and that job site conditions were maintained safe.

29 CFR  1926.20(b)(4): The employer failed to permit only those employees qualified by training or experience to operate equipment and machinery:  (a) On or about June 11, 2024, and dates prior the employer did not implement, maintain and enforce programs that would insure operators were properly trained in the safe operation and use of the Equipter RB 4000 roofing trailer when used for this re-roofing project. Employees were allowed to operate  the motorized, self positioning dump trailer without adequate training or experience.  This exposed employees to  ejection, crushing and struck by hazards.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  (a) On or about June 11, 2024, employees conducting roofing work on a 4:12 pitched first floor roof were not protected from falling to the lower level. This exposed employees to a fall hazard of approximately  Eight (8) feet, on the east side of the first floor roof onto grass and concrete.   (b) On or about June 11, 2024, employees conducting roofing work on an 6:12 pitched second floor roof were not protected from falling to the lower level. This exposed employees to a fall hazard of approximately 23 feet on the East and North sides of the roof near the ridge onto grass.

29 CFR  1926.501(b)(15): Each employee on a walking/working surface 6 feet (1.8 meters) or more above lower levels was not protected from falling by a guardrail system, safety net system, or personal fall arrest system:  (a) On or about June 11, 2024, employees assisting with roofing  activities  while working from an Equipter RB4000 elevated dump trailer were not protected from falling to the lower level by guardrails or a personal fall arrest system. This exposed employees to a fall hazard of approximately  12 feet or more onto grass and equipment.

29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  (a) On or about June 11, 2024, the employer did not ensure that employees exposed to potential fall hazards had been trained to recognize and minimize the fall hazards associated with their work. This exposed employees to a fall hazards of approximately eight (8) feet and 23 feet off the roof, and 12 feet off an elevated Equipter RB4000 dump trailer.
