29 CFR  1910.179(b)(2): Overhead and gantry cranes, constructed and installed on or after August 31, 1971, did not meet the design specifications of the American National Standard Safety Code for Overhead and Gantry Cranes, ANSI B30.2.0-1967 which is incorporated by reference.  (a) Mechanical Shop: on or about 17 June 2024 and times prior thereto: Employees were exposed to a struck-by and/or a crush hazard by using a crane to lift loads without labeling that identified the safe lifting capacity (load rating) resulting in  potential death or serious bodily harm.  (b)Cook Engine Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.179 (b)(2), which was contained in OSHA inspection number 1637696 citation number 1, item number 1a and was affirmed as a final order on 2-22-2023, with respect to a workplace located at 530 NE Tomahawk Island Drive, Portland Oregon 97217.

29 CFR  1910.179(k)(2):Rated load test. The test reports were not placed on file where readily available to appointed personnel.  a) Mechanical Shop - On or about June 17, 2024 and at times prior thereto: Employer did not have any documentation or proof of a rated load test of the crane. This exposed employees to potential struck-by and/or crushed by hazards in that the crane may be damaged internally, which may not be identified by a daily visible pre-use inspection. Without an official load test, the crane may fail resulting in a load drop.  (b) Cook Engine Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.179 (k)(2), which was contained in OSHA inspection number 1637696 citation number 1, item number 1b and was affirmed as a final order on 2-22-2023, with respect to a workplace located at 530 NE Tomahawk Island Drive, Portland Oregon 97217.

29 CFR  1910.151(c):Where the eyes or body of any person may be exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use.  a) Mechanical Shop: on or about 17 June 2024 and times prior thereto: Employer did not ensure that an appropriate eye wash was available for quick drenching or flushing of the eyes in the event of a chemical splash resulting in an exposure to an eye irritant, such as the "ZEP Heavy-Duty Degreaser and Cleaner", a Category 2A eye irritant. The employer made available two bottles of "Eyesaline" to employees, that were expired since January of 2018, for First-Aid use in the event of a splash and emergency exposure to an irritant chemical to the eyes, which could be aggravate the employee's condition, as the expired solution could be a source of a potential eye infection or irritation.  b) Cook Engine Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.151(c), which was contained in OSHA inspection number 1637729 citation number 1, item number 1 and was affirmed as a final order on 5-12-2023, with respect to a workplace located at 530 NE Tomahawk Island Drive, Portland Oregon 97217.

Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly.  a) Mechanical Shop - On or about June 17, 2024 and at times prior thereto, Employees were exposed to struck by, crush by,  and  attachment mount failure from unapproved modification and addition attachment trailer hitch ball which affects the capacity and safe operation of powered industrial truck, resulting in potential injuries or disabilities to body extremities.  Equipment: Trailer ball hitch Condition: Employees were permitted to operate a forklift with attachment without approval of Manufacturer.

29 CFR  1910.1200(j)(2)(ii):The employer did not update their written hazard communication program required by paragraph (h)(1) by June 1, 2016 to reflect changes in labeling and safety data sheets.  (a) Parts area main building: on or about 17 June 2024 and times prior thereto: Employer did not ensure current version copy of the Safety Data Sheets (SDS) of every hazardous chemical, stored or used in the workplace was readily available to all employees when they were in the work area, so the employees could immediately access the required information in contained in SDS, such as the selection of appropriate control methods and protective equipment and in case of an emergency, the first-aid treatment.
