29 CFR  1903.19(d)(1):The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  (a)  Statewide Contracting LLC failed to document abatement within 10 calendar days after the abatement date that each of the following cited violations had been corrected:  Citation 1, Item 1a, a serious violation of 29 CFR 1926.20(b)(2) with an abatement date of December 27, 2024.    Citation 1, Item 2 a other-that-serious violation of 29 CFR 1926.503(c)(3) with an abatement date of December 27, 2024.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATIONS OF THE CORRECTIVE ACTION WORKSHEET).

29 CFR  1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s)  (a)  On or about July 17, 2024, the employer did not ensure frequent and regular inspections of the job site were conducted by a competent person to ensure hazardous situations were found and corrected.  The Statewide Contracting LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.20(b)(2), which was contained in OSHA inspection number 1753147, citation number 1, item number 1 and was affirmed as a final order on August 13, 2024, with respect to a workplace located at 10364 South Rosemont Lane, Oak Creek, WI 53154.

29 CFR  1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:  (a)  On or about July 17, 2024, the employer did not ensure employees were protected by a protective helmet.  Employees were exposed to a possible danger of head injury from impact, from falling objects or materials, while working below employees installing roofing material on the second story roof of an existing residential property.

29 CFR  1926.503(c)(3): When inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill, the employer shall retrain the affected employee.  (a)  On or about July 17, 2024, the employer did not ensure employees exposed to potential fall hazards had been properly trained to recognize and minimize the fall hazards associated with their work, and how to properly install anchor points and ensure proper selection of fall protection equipment.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a)  On or about July 17, 2024, employees conducting roofing work on a new residential property with a 8:12 pitch roof, were not protected from falling to the lower level. This exposed employees to a fall hazard of approximately 23 1/2 feet to the ground below on the backside of the residential property and 10 feet over the garage.    The Statewide Contracting LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1753147, citation number 1, item number 3 and was affirmed as a final order on August 13, 2024, with respect to a workplace located at 10364 South Rosemont Lane, Oak Creek, WI 53154.
