OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that they were exposed to stuck-by and crushing hazards of collapsing storage rack systems with severe damages: On or about July 19, 2024, located in the Warehouse, employees were exposed to struck-by and crushing hazards of falling loads and steel storage racking system components due to the employer not ensuring the storage racks were structurally sound and free of damage. Warehouse aisle racking systems such as, but not limited to, C4, C5 and C6 were loaded with products and had severely damaged cross braces, bent upright columns and base plates without anchors or otherwise not secured to floors.

29 CFR 1910.178(l)(4)(ii)(B): Refresher training in relevant topics was not provided to the operator when the operator was involved in an accident or near-miss incident: On or about July 19, 2024, the employer failed to ensure that PIV operators were retrained when they have had an accident or near miss involving striking various components of the industrial steel storage racking systems throughout the warehouse. The racking systems were found to have been struck multiple times in various areas by the PIV's and have multiple structural deficiencies, such as but not limited to, missing footplate anchor screws, bent and damaged support beams, cross bars, and missing bump guards.
