29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator: Employees engaged in mixing chemicals, blending activities in the Production Lines area, the Mezz area were exposed to health hazards in that the employer had not determined, through a medical evaluation, the employee's ability to use a respirator before the employees are allowed to use respirators. Medical evaluations were not provided for employees who are wearing the half-face piece 7700 Series Honeywell North 7700 30 L respirator with Honeywell North cartridge part number 7583P100L during mixing the antimicrobial chemicals, mixing Ultraviolet Stabilizer, Antioxidant (AO) and Polystyrene Red Pigments tasks.

29 CFR 1910.178(a)(6): The employer did not ensure that all nameplates and markings were in place and maintained in a legible condition: Employees engaged in material handing activities using forklifts were exposed to struck-by hazards in that the following markings were not legible: a) Shipping/Receiving area - Toyota propane forklift #102, model 7FGU18, serial 62290, side shift indicator was not labeled, and the horn was not working. b) Shipping/Receiving area - Toyota propane forklift #102, model 7FGU18, serial 62290, rated capacity data plate dirty, not very legible to read. c) Shipping/Receiving area - Optimum Nissan 80, model unknown, serial unknown, rated capacity data plate dirty, faded, not very legible to read. d) Shipping/Receiving area - Optimum Nissan 80, model unknown, serial unknown, side shift indicator was faded not showing the label. e) Shipping/Receiving area - Yale propane forklift, model GLP080VXNGSE086, serial G813V02417H, all 3 lever indicators were not marked/labeled. f) KS2 area - Heli h2000 25 Seri propane forklift, model CPYD25-TY5, serial 230251N4289, rated capacity data plate dirty, faded, not very legible to read. g) KS1 area - Toyota propane forklift #103, model 7FGCU25, serial 76531, rated capacity data plate faded, not very legible and clear to read.
