OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to caught-in hazards from moving machinery: (a) On or about October 8, 2024, in production warehouse, employees that performed servicing and/or maintenance on equipment such as, but not limited to, tote dumpers were exposed to crush-by hazards. (b) On or about October 8, 2024, and times prior thereto, in production warehouse, employees operating the tote conveyor were clearing jams. This practice created a condition that exposed them to crushed-by hazards created by the neighboring tote dumper.
