29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    a) On or about October 28, 2024, at the residential construction site: the employer did not enforce the use of fall protection while employees installed shingles on a 36 ft high roof with a 7:12 pitch, exposing employees to fall hazards.    The ARCI, Ltd. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1656773, citation number 1, item number 1 and was affirmed as a final order on 10-05-2023, with respect to a workplace located at 3605 SW 34th St., Gainesville, Alachua FL 32608.  The ARCI, Ltd. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1598818, citation number 1, item number 1 and was affirmed as a final order on 09-14-2022, with respect to a workplace located at 13163 Ranch Road, Jacksonville, Florida 32218.  The ARCI, Ltd. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1511968, citation number 1, item number 1 and was affirmed as a final order on 08-09-2021, with respect to a workplace located at 8901 Bertha Palmer Blvd., Temple Terrace, FL 33617.
