29 CFR 1910.178(l)(4)(ii)(B): Refresher training in relevant topics shall be provided to the operator when the operator has been involved in an accident or near-miss incident; (a) On or about November 26, 2024 to January 20, 2025, the employer did not provide refresher training, including an evaluation of the effectiveness of that training, following a near miss incident where two forklifts came in contact with each other. (b) On or about January 14, 2025 to January 20, 2025, the employer did not provide an evaluation of the effectiveness of that training following a near miss incident involving a forklift and pedestrian down the main aisle between the breakroom and restroom in Lamination. (c) On or about January 14, 2025 to January 20, 2025, the employer did not provide refresher training, including an evaluation of the effectiveness of that training, following a near miss incident between a forklift and pedestrian.

29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition. On or about January 23, 2025, at an establishment located at 633 Heritage Road, De Pere, Wisconsin; Plant 3, the M312 Unicarrier stand up forklifts were not removed from service until the damaged tires were repaired or replaced.

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. On or about January 23, 2025, at an establishment located at 633 Heritage Road, De Pere, Wisconsin; Plant 3, the Unicarrier stand up forklifts were not inspected on each shift to identify defects to be reported and corrected.
