29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles.  At a worksite located at 1603 Maci Street, Belton, MO, employees were exposed to struck by hazards to their face and eyes.  The employer exposed the employees to these hazards by allowing them to utilize a pneumatic nail gun during framing activities without using eye protection.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  At a worksite located at 1603 Maci Street, Belton, MO, employees were exposed to fall hazards.  The employer exposed the employees to these hazards by allowing them to perform framing activities at heights greater than 6 feet without the use of fall protection.  Instances of exposure include but are not limited to:  1.  One employee was exposed to falls greater than 20 feet above the next lower level while working on the top level of the structure, near the southern section.   2.  One employee was exposed to falls greater than 8 feet above the next lower level while working on the top level of the structure, near the center.   Candelario Perez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1797289, citation number 1, item number 2 and was affirmed as a final order on 2/5/2025, with respect to a workplace located at 19650 W. 201st St., Spring Hill, KS, 66083.
