OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to struck-by and crushing hazards related to felling, limbing, and bucking of trees to clear a path to a monitoring well. On or about May 8, 2025, at a worksite located near N391 County Road I, Random Lake, Wisconsin, an employee was exposed to struck by and crushing hazards while assisting in the felling, limbing, and bucking of dead ash trees blocking a path to a monitoring well.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE): On or about May 8, 2025, at a worksite located near N391 County Road I, Random Lake, Wisconsin, the employer did not assess the workplace to determine if hazards were present or likely to be present when employees were operating a chainsaw to remove downed trees and brush from a path leading to a monitoring well. Employees were exposed to hazards that would necessitate PPE such as, but not limited to leg protection, head protection, face protection, hearing protection, and eye protection.
