29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s). a) 141-153 Penn Station Lane, Manheim, PA, On or about May 15, 2025, the employer did not have a competent person on the job site, and none of the employees who worked at the site inspected the job site, identified predictable fall hazards, or took immediate actions to correct the hazards. As a result, employees worked from improperly positioned ladders. They performed roofing activities at approximately 20 feet without implementing fall protection, exposing the employees to the hazard of falling to grade. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1926.1053(b)(1):Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder. a) 141-153 Penn Station Lane, Manheim, PA, On or about May 15, 2025, employees were performing residential roofing work approximately 10 feet above a lower level, utilizing an extension ladder that was not extended at least three feet above the upper landing surface, exposing the employees to a fall hazard. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) 141-153 Penn Station Lane, Manheim, PA, On or about May 15, 2025, employees installing roof shingles on a new build residential roof were not utilizing acceptable means or methods of fall protection, exposing the employee to a fall hazard of approximately 10 feet to the grade below. b) 141-153 Penn Station Lane, Manheim, PA, On or about May 15, 2025, employees installing roof shingles on a new build residential roof were not utilizing acceptable means or methods of fall protection while walking along the top ridge of the roof, exposing the employee to a fall hazard of approximately 25 feet to the grade below. The Lake Contractor Corp was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1774989, citation number 1, item number 1 and was affirmed as a final order on March 14, 2025, with respect to a workplace located at 18 Sofia Dr., Manalapan, NJ 07726. The Lake Contractor Corp was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(1), which was contained in OSHA inspection number 1781109, citation number 1, item number 2 and was affirmed as a final order on March 28, 2025, with respect to a workplace located at 450 Commerce Lane, Berlin, NJ 08009. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
