29 CFR  1926.102(a)(1):The employer did not ensure employees used eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  The employer does not protect each employee from struck-by hazards such as potential eye or face injury from physical, chemical, or radiation agents while installing roofing material with hand tools such as hammers and staplers and pneumatic nail guns. This most recently occurred on July 11, 2025; during the installation of roofing material at the job site located at 4793 Dublin Road, North Royalton, OH 44133; the employer did not ensure employees working on the roof of a single family home were protected from possible danger of eye injury from impact, or from flying objects from the employees installing roofing material with a pneumatic nail gun.

29 CFR 1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  The employer does not protect each employee from fall hazards while performing roofing activities on residential homes and or structures with unprotected sides and edges at heights of approximately 22 feet above the ground by the use of guard rail systems, safety net systems, or personal fall arrest systems. This most recently occurred on July 11, 2025; during the installation of roofing material at the job site located at 4793 Dublin Road, North Royalton, OH 44133. The employer did not ensure employees working on the roof of a single family home were protected from a fall of approximately 22 feet by utilizing a fall protection system.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  The employer does not protect each employee from fall hazards while climbing onto the landing zone to perform roofing activities on residential homes and or structure at heights of approximately 22 feet above the ground  This most recently occurred on July 11, 2025, during the installation of roofing material at a job site located at 4793 Dublin Road, North Royalton, OH 44133; the employer did not ensure employees were protected from a fall by extending the portable ladders 3 feet above landing zones.  SKWINKLES HOME IMPROVEMENT, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(B)(1), which was contained in OSHA inspection number 1559388, citation number 02, item number 001  and was affirmed as a final order on (3/3/2022), with respect to a workplace located at 1031 Minuteman Ave NW, Massillon, OH 44646.  SKWINKLES HOME IMPROVEMENT, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(B)(1), which was contained in OSHA inspection number 1475747 citation number 01, item number 01 and was affirmed as a final order on (7/16/2020), with respect to a workplace located at 341 Baxter St, Medina, Ohio 44256.
