29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  The employer does not protect each employee from fall hazards while performing roofing activities on residential homes and or structures with unprotected sides and edges at height of approximately 10 feet above the ground using guard rail systems, safety net systems, and or personal fall arrest systems. This most recently occurred on or about July 22, 2025, during a roof replacement on a job site located at 31567 Lake Road, Bay Village, OH. Employees are exposed to the hazard of falling approximately 10 feet to the ground while working on a roof of a single-family home installing roofing material without the use of fall protection and or a fall protection system.  Melvin Mejia DBA MEJIA ROOFING AND CONSTRUCTION LLC was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1732423, citation number 1, item number 1 and was affirmed as a final order on 06/14/2024, with respect to a workplace located at 3874 Kenway Blvd, Uniontown, OH, 44685.  Melvin Mejia DBA MEJIA ROOFING AND CONSTRUCTION LLC was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1677346, citation number 2, item number 1 and was affirmed as a final order on 07/18/2023, with respect to a workplace located at 28625 Bassett Road, Westlake, OH, 44145.  MEJIA ROOFING AND CONSTRUCTION LLC was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1634020, citation number 1, item number 1 and was affirmed as a final order on 02/08/2023, with respect to a workplace located at 1925 Wales Rd NE, Massillon, OH 44646.  MEJIA ROOFING AND CONSTRUCTION LLC was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1619527, citation number 2, item number 1, and was affirmed as a final order on 12/1/2022 , with respect to a workplace located at 9220 Wellspring Ave NW, North Canton, OH 44720.   Melvin Mejia was previously cited for a violation of this occupational safety and health standard, 1910.501(b)(13), which was contained in OSHA inspection number 1509916, citation number 1, item number 1, and was affirmed as a final order on 03/02/2021 with respect to a workplace located at 2101 Wager Road, Rocky River, Ohio.  MEJIA ROOFING AND CONSTRUCTION LLC was previously cited for a violation of this occupational safety and health standard equivalent standard (1926.501(B)(11), which was contained in OSHA inspection number 1474016, citation number 02, item number 01 and was affirmed as a final order on (5/14/2020), with respect to a workplace located at 2818 S. Arlington Rd, Akron, OH 44312.
