29 CFR 1926.651(c)(2):A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: On or about July 16, 2025, employees of FDR Construction LLC. were engaged in excavation activities at a jobsite located at 3722 Frostfire Avenue, Grand Island, NE 68803, where employees exposed to caught between and crushing hazards in that the employer failed to ensure the employees were provided a safe means of access and egress to the trench they were working out of. Specifically the employees were climbing up and over the approximate 5-6 foot walls of the trench as means of access and egress.

On or about July 16, 2025, employees of FDR Construction LLC. were engaged in excavation activities at a jobsite located at 3722 Frostfire Avenue, Grand Island, NE 68803, where the employer had employees exposed to caught between and crushing hazards in that they were working in an unprotected approximate 5-6 foot deep trench without any cave-in protections.

29 CFR 1904.39(a)(2):The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye. On or about July 16, 2025, the employer of FDR Construction LLC. located at 4241 Michigan Ave., Grand Island, NE 68803, failed to report an employee in-patient hospitalization within 24-hours. The incident occurred and the employer became aware of the hospitalization on July 16, 2025, however, the employer did not report the incident until July 18, 2025.
