29 CFR 1910.37(a)(4): Safeguard(s) designed to protect employees during an emergency (e.g., sprinkler systems, alarm systems, fire doors, exit lighting), were not in proper working order at all times:     a) 255 N. Rehoboth Blvd, Milford, DE 19966: On or about 11/17/2025 and at times prior, CSHO observed emergency fire protective systems not functioning due to a broken water main in the sprinkler system limiting the area of service. The employer took no additional steps to limit employee exposure while the sprinkler system was out of service.

29 CFR 1910.151(b): There was neither an infirmary, clinic, or hospital used for the treatment of all injured employees in near proximity to the workplace nor a person or persons adequately trained to render first aid.  a) 255 N. Rehoboth Blvd, Milford, DE 19966: On or about 11/17/2025 and at times prior, the employer did not ensure that an injured employee received prompt and appropriate medical attention following a workplace incident. Specifically, after a fall resulting in injuries requiring medical treatment and subsequent specialist evaluation, the employee was not transported directly to a hospital or infirmary for immediate care. This lack of timely medical response exposed the employee to unnecessary risk of exacerbating the injury.

Violative instances included but were not limited to:  a) Case No. 00100-2025-002- the provided log received on November 24, 2025 did not reflect in Block (L), On job transfer or restriction, injured employee was placed on restriction November 18, 2026   In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

Rehoboth Blvd, Milford, DE 19966: On or about 11/17/2025 and at times prior, the employer had not  filled out OSHA Forms 301 in completeness for incident 00100-2025-002.  Violative instances included but were not limited to:  1) Occurring on 11/17/2025 had an OSHA Form 301 that was not filled out in a complete manner. Question 15 was not filled out and failed to tell how the injury occurred.   In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
