29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  At the temporary job site located at 12055 W. Arvada Blvd., Wichita, Kansas, employees performing roofing activities were exposed to fall hazards. Employees were exposed in that the employer had not provided training or instructions to employees regarding the recognition and avoidance of unsafe conditions associated with construction work and the methods to mitigate those hazards, including but not limited to: how and when to use fall protection equipment, safety glasses, hard hats, and how to set up and use ladders properly.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  At the temporary job site located at 12055 W. Arvada Blvd., Wichita, Kansas, employees engaged in roofing activities were exposed to struck-by hazards. Employees were utilizing pneumatic nail guns without eye protection.  Agustin Rojas was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.102(a)(1), which was contained in OSHA inspection number 1834970, citation number 1, item number 1, and was affirmed as a final order on 09-11-2025, with respect to a workplace located at 4821 N. Vassar Ave, Wichita, KS 67220.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):  At the temporary job site located at 12055 W. Arvada Blvd., Wichita, Kansas, employees engaged in roofing activities were exposed to fall hazards of approximately 10.0 feet from the eave of the roof to the ground below in that fall protection was not utilized.  Agustin Rojas was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1664924, citation number 1, item number 1, and was affirmed as a final order on 06-28-2023, with respect to a workplace located at 226 S. Wellcrest Ct., Goddard, KS 67052.  Agustin Rojas was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1826823, citation number 1, item number 1, and was affirmed as a final order on 07-30-2025, with respect to a workplace located at 4928/4930 N. Vassar Ave., Wichita, KS 67220.  Agustin Rojas was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1834970, citation number 2, item number 1, and was affirmed as a final order on 09-11-2025, with respect to a workplace located at 4821 N.
