Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health
Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees, in that employees were exposed to fall hazards of 13-16 feet
while loading and
securing railcars:
(a)Core Railcar Loading Area - Employees were observed working on top of a
railcar and the load 13-16 feet above the ground and the employees were
not provided
nor were they using fall protection.
Among others, one feasible and useful abatement method to correct this
hazard is to:
Manufacture and/or provide any of the fall protection systems or devices
available for
use in railcar loading and unloading applications and ensure the proper
use of the fall
protection devices and systems when loading and securing the load.
