Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees
in that employees
were exposed to the hazard of being crushed while riding a vertical
reciprocating conveyor:
a- Shipping/Receiving Area - On or about 04/30/07 an employee sustained
multiple
fractures to both ankles when riding the vertical reciprocating conveyor.
The operating
rope for the conveyor failed.  The car of the vertical reciprocating
conveyor fell
approximately 13 feet before striking the concrete floor.
Feasible and acceptable methods among others to correct these hazards
include:
1) Train employees in the safe operation of the conveyor and ensure that
it is never used
to move personnel;
2) Maintain all guards, gates and safety features such as but not limited
to door
interlocks;
3)  Ensure that the vertical reciprocating conveyor is maintained,
operated and inspected
as per ANSI B20.1-2006 Sections 5.2(b), 5.9.1.4, 5.11.3, 5.12(a), 5.12(d),
5.12(g),
5.12(h) and 6.21.2(e).
