North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by falling load a)maintenance room- manually operated lever hoist, not marked with load, no inspection, no operators manual, controls not marked, no identification placard, no maintenance, damaged, and with unauthorized hardware, bolted to a wood beam, was being used by maintenance personnel to lift equipment for maintenance One feasible means of abatement is to replace the hoist with an inspected, appropriate hoist such as a chain fall or other means of hoist.
