29 CFR 1926.404(f)(6): The path to ground from circuits, equipment, or enclosures was not permanent and continuous: (a) A the front side of the building on or about June 6, 2012 and at times prior thereto, an employee was using an extension cord with a missing ground pin to provide temporary electrical service to a DeWalt DW511 ? VSR Hammerdrill. The hammerdrill was used to drill holes on the exterior concrete wall.

29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed: (a) At the front side of the building on or about June 6, 2012 and at times prior thereto, an six foot stepladder was used in the folded/closed position and leaned against the exterior wall to access the upper wall area. The top of the exterior wall was about 9 feet to the ground below. The employee utilized the stepladder as a working platform in order to secure wooded forms onto the concrete wall.
