29 CFR 1926.50(c): A person who has a valid certificate in first-aid training was not available at the worksite to render first-aid: At the side of the carport on November 12, 2013, and times prior thereto, there was no person on-site who had a valid certificate in first-aid training from the U.S. Bureau of Mines, the American Red Cross, or equivalent training. Documentary evidence of certification was not be available at the worksite. NOTE: Distance from the worksite to the Guam Memorial Hospital is approximately 9.7 miles. Estimated time is about 19 minutes.

At the roof of the project site on November 12, 2013, two employees tying rebar were not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Employees were exposed to a fall hazard of about 9 feet, 4 inches to the ground.

The top of the ledge was about 12 feet above the ground.

29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed: At the side of the carport on November 12, 2013, employees used a ten foot fiberglass stepladder with the metal spreader or locking device in the partially closed position to access the roof. The metal spreader or locking device is designed to hold the front and back sections of the stepladder when the ladder is being used.
