29 CFR 1926.300(b)(1): Power operated tool(s), designed to accommodate guards, were not equipped with such guards when in use: (a) At the project site on or about October 29, 2012, and at times prior thereto, a Makita 4 1/2" grinder, serial number 1192188, was used to etch concrete. The grinder was missing its guard thus, exposing operator to exposed moving parts.

29 CFR 1926.404(b)(1)(i): Employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section, or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites. (a) At the project site on or about October 29, 2012, and at times prior thereto, there was no ground-fault circuit-interrupter protection or an assured equipment grounding conductor program when extension cords were used to power a 110V AC Makita 4 1/2" grinder, serial number 1192188. The grinder was used to etch concrete.
